Terms of Service

Welcome to DegenDen. These Terms of Service ("Terms") govern your access to and use of the DegenDen mobile application, website, and related services (collectively, the "Service") operated by DegenDen ("we," "us," or "our"). By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and that they have read and agree to these Terms on your behalf. We reserve the right to require proof of age or parental consent at any time. The Service is intended for users in jurisdictions where skill-based games are permitted. You are responsible for compliance with local laws.

2. Account Registration and Security

To access certain features, you must register an account with a valid email address, username, and password. You must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must promptly notify us of any unauthorized access. We are not liable for any loss arising from unauthorized use of your account. One person or entity may maintain only one account. Accounts are non-transferable.

3. Description of the Service

DegenDen provides skill-based games where player ability, reflexes, and strategy determine outcomes. Our games are free to play. You compete using in-app virtual currency ("Coins") to enter rounds, earn rewards through gameplay, complete missions, participate in leaderboards, and redeem referral bonuses. The Service is a game of skill, not chance. Outcomes are determined by player performance, not random luck.

4. Virtual Currency (Coins)

Coins are virtual in-game currency used solely within the Service. Coins have no monetary value, cannot be exchanged for real money, and cannot be transferred, sold, or redeemed outside the app. You receive a license to use Coins for gameplay only; you have no ownership or property interest in Coins. Coins may be earned through gameplay, missions, referrals, daily rewards, ad claims, or other promotional activities. We may modify, limit, or discontinue Coin earning mechanics at any time. Coins are non-refundable and non-transferable except as expressly permitted within the Service (e.g., gameplay stakes). Any attempt to buy, sell, or trade Coins outside the app, or to exploit bugs to obtain Coins improperly, is strictly prohibited and may result in immediate account termination.

5. In-App Purchases

We offer optional in-app purchases of Coins through the Apple App Store (or other platform stores). All purchases are final and non-refundable except as required by applicable law or platform policy. Refund requests for purchases must be directed to Apple (or the applicable store); we cannot process refunds directly. Prices are displayed before purchase. By completing a purchase, you acknowledge that you understand Coins have no real-world value. We may offer promotional packs, bonuses, or special offers; these are subject to change or withdrawal without notice.

6. Referral Program

The referral program allows you to share a referral code with others. When a new user signs up using your code, both you and the referred user may receive Coin bonuses as described in-app. Referral codes may only be shared through lawful means. Spam, fraud, fake accounts, or abuse of the referral system is prohibited. We may modify or discontinue the referral program and void fraudulent rewards at our sole discretion.

7. User Conduct

You agree not to: (a) violate any applicable laws or regulations; (b) use cheats, bots, exploits, or unauthorized third-party software; (c) harass, abuse, threaten, or harm other users; (d) impersonate any person or entity; (e) use the Service for any commercial purpose without our written consent; (f) attempt to gain unauthorized access to our systems or other accounts; (g) circumvent any security or anti-cheat measures; (h) interfere with or disrupt the Service or servers; or (i) use the Service in any way that could damage our reputation. We may suspend or terminate your account for any violation and report illegal activity to authorities.

8. Intellectual Property

The Service, including all games, graphics, designs, text, software, and content, is owned by DegenDen or our licensors and is protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial entertainment. You may not copy, modify, distribute, reverse engineer, create derivative works, or exploit our content except as expressly permitted. All rights not granted are reserved.

9. No Gambling

DegenDen games are skill-based competitions. Outcomes are determined by player skill, not chance. Coins cannot be exchanged for real money or withdrawn. The Service does not constitute gambling, wagering, or betting under applicable laws. If skill-based games are restricted in your jurisdiction, you may not use the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEGENDEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless DegenDen and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. You may terminate your account by ceasing use and contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including Sections 4, 5, 8, 10, 11, 12, and 15) will survive termination.

14. Modifications

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or in the app. The "Last updated" date will reflect the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service. For significant changes, we may provide additional notice (e.g., in-app prompt or email).

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and the arbitrator's decision shall be final and binding. You waive any right to participate in a class action or representative proceeding. You may opt out of this arbitration agreement by sending written notice to us within 30 days of first accepting these Terms. Some jurisdictions do not permit arbitration of certain disputes; nothing herein limits your right to pursue relief in small claims court for qualifying claims.

16. General

These Terms constitute the entire agreement between you and DegenDen regarding the Service and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right. If any provision is held invalid, the remaining provisions remain in effect. We may assign our rights and obligations under these Terms; you may not assign without our consent. Nothing in these Terms creates any partnership, joint venture, or agency relationship.
